Purpose

The website, accessible at the web address http://alumni.ut-capitole.fris a private professional social network published by Toulouse Capitole University allowing its members (students, graduates, and others) to offer mutual support, keep in touch, facilitate networking, share opportunities, exchange advice, capitalise on training, facilitate integration into the world of work, and post job and career opportunities. The Site and its services are provided by the “AlumnForce” application developed by MEVIA, a simplified joint-stock company with capital of €11,300, registered in the Trade and Companies Register of Nanterre under number B 501 609 143, and whose registered office is located at 93-97 rue Eugène Caron, 92400 Courbevoie, France. 

The objective of these Terms and Conditions is to provide a framework for the access to and use of the Site. We encourage you to carefully read its contents.


By activating your Account, submitting an Account request, booking an event or making a purchase on the Site, you acknowledge having read, and accepted all the contents of these Terms and Conditions.


Definitions

Terms starting with a capital letter in the Terms and Conditions denote the following (except if expressly stipulated in some other way):

  • The Site denotes the Toulouse Capitole University website accessible at the following web address http://alumni.ut-capitole.frand providing access to network Services;
  • Users denote members who are able to access the services by means of their Account (students, graduates, lecturers, recruiters), physical persons signing up to an event, and Administrators. For each User type, access to services can be limited, at the Administrators’ discretion.
  • Administrators denote physical persons who may or may not be employed by Toulouse Capitole University who are permitted to use the AlumnForce application for professional purposes or for Module management: they have access to an Account allowing them to configure Modules and configure or perform certain actions on User Accounts; 
  • Account denotes a valid account providing access to the Site’s Services;
  • Content denotes any content that Users may download and access from the Site, including but not limited to articles, events, directories and profiles containing Personal Data depending on the privacy settings that each User has configured in their preferred settings;
  • Personal Data denotes all data of a personal nature relating to a physical person who is, or may be, identified;
  • Modules denotes the management applications of the private professional social network developed by AlumnForce that are accessible as “Software As A Service” (SaaS);
  • Privacy Policy denotes the document compiled by Toulouse Capitole University stipulating its processing of User’s Personal Data and defining related rights;
  • Services denote the provision of Modules and additional services that may be provided by AlumnForce at Toulouse Capitole University’s request, in particular concerning configuration, support, training, etc.;


Scope of the Terms and Conditions

These Terms and Conditions govern any use and access to the Services offered on the Site. They are validated electronically by Users when they open an Account, and each time the Terms and Conditions are updated. The Terms and Conditions can be accessed on the Site at all times. The professional social network does not offer open access. Access is reserved for network Users who have accepted the Terms and Conditions and have an Account with a username and password.

Users acknowledge that they have read and understood the Terms and Conditions and accept that they are bound by them.

Toulouse Capitole University reserves the right to modify the Terms and Conditions at any time, with email notification of the new version sent to Users, who undertake to take note of these changes.


Description of the services provided by Toulouse Capitole University

Toulouse Capitole University offers its members the type of services described below:

  • A participative information service for the network and for sharing items (news, events, discussions, newsletters, activity walls, comments, internal messaging, notifications, items posted to social networks, etc.) 
  • A directory of User members offering access to User profiles
  • A networking service between User members through internal messaging
  • A job offer service
  • A participative Group service 
  • A subscription service to benefit schemes
  • Services enabling online donation, ticketing, journal subscription and product purchases 
  • A service displaying special offers, projects and advertisements
  • A referral and mentoring service
  • A permanent email address service based on an alias allowing for redirection to an email address of your choice,
  • and more.

The aim of these services is to bring together members of Toulouse Capitole Universityin order to facilitate networking, mutual aid, integration into the world of work, and career opportunities.


Access to the services

Site users acknowledge that they possess the abilities and means required to access this Site, that they have checked that the IT configuration they use does not contain any viruses, and that it is in optimal working order.

In order to gain access to the network, the User needs to be a graduate, student or lecturer at Toulouse Capitole University and have an active email address to activate their account and participate in network activities. Their Account will need to have been created beforehand by an Administrator. 

Anonymous visitors can access the Site, view articles and public events, but they may not view profiles, post comments or participate in discussions. They may have access allowing them to sign up to events open to members of the public. In this case they will need to accept the Terms and Conditions in order to secure their own participation in this type of event, and provide at least their First name, Last name and an active Email address.

Recruiter Site users or those who are representatives of a partner company will be able to join the network, with limited access, in order to post job offers. These Accounts need to be validated or created beforehand by an Administrator.

Users agree not to use a username or email address that could harm the rights of third parties (surname, brand, etc.), nor to usurp a name, a corporate name or registered trademark.

On first connection, Users will need to accept and validate the Terms and Conditions, specify a password and update their Account preferences in terms of notifications and privacy levels for information contained on their profile. Their account may be deactivated and then deleted by an Administrator if it remains inactive for more than two years.


Administrators

Administrators state that they are authorised to use the Services and that they have accepted the Terms and Conditions on behalf of Toulouse Capitole University. Administrators set up and configure User Accounts through importation or individual inputs. They configure and validate User access requests as representatives of partner companies. Administrators are entitled to send login details to each User. Administrators are entitled to block User access when required.


User accounts

Users can access Services once the Terms and Conditions have been validated and only if the User Account has been created beforehand by an Administrator based on at least a First name, Telephone no. and active Email address. Users will be required to provide at least an active email address and to specify a password for authentication on first login. They may change and update their email address and password at any time through their Account settings. They will then access the User menu to access the various platform Modules which will be accessible according to permitted access based on User type. 


Password

The password associated with each Account is strictly personal and confidential and may not be shared with any third party. Users are responsible for the loss or theft of their password. We advise Users to regularly change their password and to choose complex passwords of at least 8 characters combining letters, numbers and special characters. All Users may change and update their password at any time through their Account settings.


Use of services

Text, software, images, videos, data and any other work displayed on this Site are protected by the Intellectual Property Code. Site Users undertake not to reproduce them without the express consent of Toulouse Capitole University. Users undertake not to copy or sell all or part of the Modules and the Site.

Users provide Toulouse Capitole University with the assurance that they hold the necessary rights, including all applicable intellectual property rights over the articles, testimonials, comments, images and data of any nature that they may divulge on this Site, allowing them to grant the rights conveyed herein.

Users expressly agree, and at no cost, that their testimonials and comments may be reproduced and/or represented in the communication media intended for the promotion of Toulouse Capitole University throughout the legal duration of protection of these comments and testimonials.

Messages and images posted are the responsibility of their author who undertakes to assume all the responsibilities and consequences related thereto. Specifically, the author of such a message provides Toulouse Capitole University with a guarantee against any action taken by third parties of which the purpose, basis or origin is the content of the message. They therefore undertake to bear the cost of any convictions and related defence costs, or any transactional compensation that may be due within the context of the dispute. Site representatives shall not under any circumstances be held liable for the content of any messages posted by Users.

Users are responsible for the Account assigned to them, from the date of activation of said Account. They must keep their Account login details confidential and not divulge them to any other person. Users are solely responsible for the use made of their Account, as well as for Content published through this Account.

For the respect and good of all, the following are forbidden: messages of an offensive, obscene or defamatory nature, content violating the rights of others, content inciting violence or racism, pornography, paedophilia or crimes and misdemeanours, and misuse of the Site for the purposes of propaganda, business development or politics.

Users may inform Administrators of any disturbing messages. Administrators may delete any message that does not comply with the abovementioned conditions, without prior notice.

Toulouse Capitole University reserves the right, without justification, to decline access to any Site User or Visitor who has not upheld these Terms and Conditions or the applicable law. If the Visitor or the User concerned believes it is an error, they may contact Toulouse Capitole University.


Group participation

The Site allows Users, if the Group Module is active, to create restricted inner circles within the network. These can be arranged into groups, for example based on a particular town, region or professional topic. The members of each group may therefore have articles, events, forums, media, and a directory specific to their group. Each group and its members must uphold the provisions of these Terms and Conditions.


Posting job offers

All Site Users who submit a job offer undertake not to use prohibited or discriminatory criteria including the following: origin, gender, morals, orientation or sexual identity, age, family status or pregnancy, genetic characteristics, actual or supposed belonging or non-belonging to an ethnic group, nation or race, political opinions, trade union or mutual benefit company activities, religious convictions, physical appearance, etc. (Article L 1132-1, L 1142- 1, L 5531-2 of the Labour Code)


Protection of personal data and privacy policy

The body responsible for processing the personal data referred to in these provisions is Toulouse Capitole University.

  Data initially integrated concerning Site Users is supplied by 
Toulouse Capitole University. This data is necessary to obtain an Account and access to the provided Services. This involves at least First name, Last name, Email address, and academic career.

The other data is optionally updated by the Users themselves from their profile in order to present their expertise and projects to other Users with a view to interacting and creating opportunities for discussions, networking, and generating statistics on occupational mobility:

- Profile photo

- Presentation

- Personal details (telephone no., mobile no., personal email address(es), primary and secondary address), date of birth, marital name, family status

- Current job and work contact information (position, type of position, company, industry)

- Previous job(s)

- Current situation and career goals

- Acquired skills and spoken languages

- Additional training

- Charity activities and hobbies

- Curriculum vitae (via the downloaded file or generated based on the abovementioned information)

User identities are only visible publically if the User has activated their public profile or Public CV. Each User is free to activate or deactivate their public profile at any time.

User identity (First name, Last name, Photo, City, Country, Position, Company) is visible to other Users via the Directory (list and map view) and from any interaction on the professional social network through an activity or participation on the part of the User concerning an article, event, comment, groups or discussions.

The information gathered from network Users via their profile and form may only be viewed by other network Users (students, graduates, permitted recruiters and Administrators). By managing their privacy settings, Users can restrict access to information contained on their profile according to User type.

Recruiter type users or partner company representatives supply the following information for the creation of an Account:

- Title, First name, Last name, Email address, Position in the company

- Company name and address

Visitors external to the network who sign up to an event need to provide at least the following information:

- First name, Last name, Email address

and depending on certain events, the following information:

- Physical address, Telephone number, Mobile number, Date of birth, Current position, Company, Business address, Work email address

As part of payment for a service on the Site (a ticket for an event, social welfare contributions, a gift or a subscription), we request the delivery and invoicing address to create an order and associated receipt. We do not store any information related to credit cards or banking details.

When Users make use of the Site, we automatically gather information, including personal data, about the services used, and the manner in which they are used. This information is necessary for proper execution of the agreement between both parties, so that we comply with legal obligations, and it supports our genuine interest in being able to provide and improve the functionality of the Site:

- geolocation information: in order to offer a better user experience, when using certain functionalities on the Site, we are able to gather User information about their location based on their IP address or through the GPS system of their mobile device. Most mobile devices allow you to control or disable the use of geolocation services in applications, through the device settings menu. 

- information about usage: in order to improve the services on the Site, we collect information based on your activities on the Site, such as your viewing of pages or content, the searches you conduct, purchases that you have made and other actions you take.

- login and device information: we automatically gather login and device information when you access the Site. Amongst other items of information, this includes information about your use of the Site, your IP address, access dates and times, information about the IT equipment and software used, information about the device used, information related to use of the device, unique logins, information related to IT crashes, and cookies. This information allows us in particular to improve Site performance and the quality of the Services offered as well as to detect and flag fraud, spam, abuse, security incidents and other harmful activities.

Users agree to always provide accurate, reliable Personal Data, and to update this information if necessary to ensure it remains complete and accurate. We may contact you regularly in this regard.

User information contained in the professional network database remains the property of the User concerned. In accordance with the European regulations in force, Site Users have the following rights: 

- the right to access (article 15 of the GDPR) and correct (article 16 of the GDPR), update, and complete User data 

- the right to delete User information of a personal nature (article 17 of the GDPR), 

- the right to withdraw consent, at any time (article 13-2c of the GDPR) 

- the right to limit the processing of User data (article 18 of the GDPR) 

- the right to oppose the processing of User data (article 21 of the GDPR)

- the right of transferability of the data that Users have provided (article 20 of the GDPR)

Network Users are entitled to freely edit or delete information that they have submitted to the network. They may also request that personal information be corrected, completed, clarified, updated or deleted by Toulouse Capitole University. No personal information is collected without the knowledge of network members.

You may exercise this right:

  • by updating personal information through management of your Account, in the “My Profile” section.

Toulouse Capitole University is the sole entity authorised to store data and it undertakes not to sell or transfer it to any third party, or to make use of it for any other purpose than for publishing it on the Site. Toulouse Capitole University is likely to process your own personal data as part of granting you access to and/or your use of the Site. This mainly concerns the data that is collected by Toulouse Capitole University when a User activates their account or updates information on their profile.

The Toulouse Capitole University Site is protected by the provisions of the Intellectual Property Code, in particular in terms of data protection. Any person who compiles a file or database using the information displayed on the Toulouse Capitole University Site, and who may provide such information to a third party, at no cost or for a fee, without having obtained permission from Toulouse Capitole University shall be in breach of these Terms and Conditions, and shall be liable for the civil and/or criminal penalties provided for in the Intellectual Property Code.

Toulouse Capitole University reserves the right to modify this Privacy Policy in order to comply with changes to the law and regulations in force. Any modifications applied shall be communicated on our Site or by email, as far as is possible, at least thirty days prior to their taking effect.


Duration of data storage

We shall only keep data for the period of time necessary to fulfil its intended purpose, in accordance with the legal provisions in force.


Security

Site Users acknowledge that they are aware of the risks associated with the use of the Internet and networks, and in particular that information relating to personal data may be copied or intercepted. The Site User acknowledges that they accept these risks, for which Toulouse Capitole University may not, under any circumstances, be held responsible. Toulouse Capitole University draws on all technical and human resources necessary to ensure a permanent level of security in accordance with the latest regulations in force in this domain and to prevent attacks by malicious parties. Some of the protective measures we use to protect personal information are firewalls and encrypted data transmission using SSL/HTTPS technology.


Guarantee

Toulouse Capitole University undertakes to take special care to ensure the accuracy of the information shared on the Site, and to keep it updated regularly. However, errors or omissions may be observed. In this case, we request that you inform us thereof so we can take the necessary corrective actions. When conducting ad-hoc checks and performing work on the Site, the Site Administrator agrees not to modify the Content in any way that could serve to change its meaning. However, they reserve the right to move Content if they find a blatant error in terms of the classification of topics.

Toulouse Capitole University does not guarantee uninterrupted access to the Site, particularly in the event of work being conducted on it for maintenance, repairs, or due to disruptions to internet connections. It shall not be held responsible for technical defects or any related loss of data, nor for any other indirect damages that may arise during, or related to, use of the Site.


Applicable law 

The Terms and Conditions are governed solely by French Law. Any dispute arising from the validity, interpretation and/or execution, termination, or breach of these Terms and after failure of a conciliation attempt, shall be referred to the Commercial Court of Toulouse.
